Terms of Service for Chhabi

1. Acceptance of Terms

By creating an account or using the App, you agree to these Terms and our Privacy Policy. You must be at least 13 years old to use this App. If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian's permission to use the App.

2. Subscriptions and In-App Purchases

Chhabi offers free features as well as premium auto-renewing subscriptions ("PRO" features).

• Billing: All payments, subscriptions, and refunds are handled entirely by the Google Play Store. By initiating a purchase, you agree to the pricing, payment terms, and billing frequency displayed at the time of purchase.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Cancellation: You may manage your subscriptions and turn off auto-renewal at any time by going to your Google Play Store Account Settings after purchase. We cannot cancel subscriptions on your behalf.
• Refunds: Because all billing is handled by Google Play, refund requests are subject to Google Play's refund policies.

3. User Content and AI Processing

Chhabi allows you to upload, edit, and save images ("User Content").

• Ownership: You retain all rights, title, and ownership of your User Content. We do not claim ownership over the photos you edit using our App.
• AI Processing: Chhabi uses artificial intelligence, including on-device processing via Google ML Kit, to apply edits, filters, and background removals. By using these features, you consent to this processing.
• Prohibited Content: You agree not to use the App to create, edit, or share content that is illegal, abusive, harassing, explicit, defamatory, or violates the intellectual property rights of any third party. We reserve the right to suspend or terminate your account if you violate these rules.

4. Intellectual Property

All materials within the App, including but not limited to software, designs, text, templates, stickers, fonts, and graphics (excluding your User Content), are the intellectual property of Chhabi and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the App and its assets strictly for personal, non-commercial purposes in accordance with these Terms.

5. Account Registration and Security

To access certain features, you may be required to register an account via third-party providers (e.g., Google Sign-In).

• You are responsible for maintaining the confidentiality of your account login information.
• You are responsible for all activities that occur under your account.
• We reserve the right to suspend or terminate your account at any time, without notice, if we suspect unauthorized use or a breach of these Terms.

6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE AVAILABILITY, RELIABILITY, OR ACCURACY OF THE APP, INCLUDING ITS AI EDITING CAPABILITIES. WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHHABI AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF YOUR ACCESS TO OR USE OF THE APP.

8. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time without notice. We may also update these Terms occasionally. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
